Reporting on waste generated in the BDO system
Reports to the Marshal of the Province are submitted exclusively electronically via the BDO (Waste Database).
Entities required to prepare an annual report on medical waste generated shall submit them by 15 March for the previous calendar year to the Marshal of the Province competent for:
- Registered office or place of residence of the producer of medical or veterinary waste – in the case of a report on products, packaging and waste management. In the absence of a registered office or place of residence, the appropriate addressee is the Marshal of the Mazovian Province.
- Place of production, collection or processing of waste – in the case of a report on waste generated and waste management. For example, if waste is generated in two provinces, we submit two reports, separately to each Marshal of the Province.
- The place where the entrepreneur runs a retail or wholesale trade unit offering plastic shopping bags subject to a recycling fee.
Entities required to prepare the reports referred to above prepare these reports via an account in the Database of Products and Packaging and Waste Management (BDO).
In the event of a BDO failure that prevents the submission of a report within the time specified in the Waste Act, medical waste producers must submit reports immediately after the failure ceases. Failure to comply with this obligation is punishable by a fine in accordance with the Code of Offences.
In the event of permanent cessation of business, the medical waste producer shall prepare and submit reports within 7 days from the date of cessation of business.
"ZERO" REPORTS
The regulations do not precisely regulate the issue of submitting so-called "zero" reports on medical waste produced and waste management. Nevertheless, there is such a possibility in the BDO system, by introducing a zero mass of medical waste. This issue is not specified. IOŚ – State Research Institute, which, together with the Ministry of Climate, runs the BDO system, claims that there is no obligation to submit zero reports, but some Marshal's Offices have different opinions on this subject. In individual voivodeships, officials recommend submitting a "zero" report on the medical and veterinary waste produced. However, in other offices you can receive information that there is no need to submit a "zero" report. In connection with the above and in the absence of clear information, many producers of medical and veterinary waste decide to submit the above report. Such a report should contain a supplemented Section I and Section XI.
