§ 1 General provisions

1. The EKORR online store (hereinafter "EKORR") conducts sales via the Internet, based on these Regulations (hereinafter "Regulations").

2. The condition for making purchases at EKORR is the acceptance of the Regulations by the Buyer.

3. The Regulations are part of the sales agreement between EKORR and the Buyer.

4. Prices given in EKORR are expressed in Polish zloty, are gross prices and include VAT.

§ 2 Orders and delivery dates

1. The condition for the completion of the placed order is the correct completion by the Buyer of the order form, available on the EKORR store website https://www.ekorr.pl

2. When completing the order form, the Buyer is obliged to provide true address and contact details (phone, e-mail).

3. EKORR is not responsible for failure to deliver the ordered goods or delay in its delivery caused by incorrectly provided address by the Buyer.

4. Orders through the EKORR store can be placed 24 hours a day, 7 days a week.

5. EKORR reserves the right to refuse the completion of a placed order that raises doubts, e.g. without providing a phone number or e-mail address, without which it will not be possible to confirm the placed order.

6. Orders should be placed through the EKORR store using the form contained therein and adding products to the basket.

7. Each order placed by the Buyer is confirmed by phone or electronically (e-mail).

8. Orders are processed within 1 - 7 days from the moment of order confirmation.

9. In the event of circumstances affecting partial or complete delivery of the ordered goods, the EKORR employee agrees with the Buyer by phone or electronically (e-mail) on further proceedings aimed at finalizing or canceling the delivery.

10. The purchased goods are delivered to the address indicated in the order form.

11. The Buyer covers the transport costs.

12. The Buyer should check the received goods in the presence of the supplier (courier company employee).

13. The order processing begins after the amount due has been credited to the EKORR bank account.

14. Goods are delivered only within Poland.

§3 Delivery costs

1. EKORR sends the ordered goods via the DPD courier company.

2. Shipping of goods via DPD courier company - cost from PLN 22.90 (in words: twenty-two zlotys, ninety groszy).

3. Detailed shipping costs will be visible in the basket when placing the order.

§4 Payment methods

1. For purchases at EKORR, the Buyer makes payments via the Przelewy24.pl service. The service allows for payment by credit card or fast online transfer.

2. The payment card operator is PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000347935, NIP 7792369887, Regon 301345068.

§5 Purchase document

1. Buyers receive a VAT invoice together with the ordered goods.

§6 Complaints

1. All goods offered by EKORR are brand new, unused and have a guarantee.

2. The basis for accepting a complaint is the possession and presentation of a purchase document (VAT invoice) by the Buyer.

3. After receiving the shipment, the Buyer should check its contents and inform EKORR about any damage during transport.

4. If the contents of the shipment are damaged upon receipt, the Buyer should write a protocol in the presence of the courier and not accept the shipment or notify EKORR.

5. EKORR is not liable for damage caused as a result of improper use of the purchased goods.

6. Goods returned for the purpose of complaint should be sent to the address EKORR Rybiccy Sp. J. ul. Instalatorów 23 lok.101, 02-237 Warsaw together with the VAT invoice received with it.

7. Individual settings of the Buyer's screen and computer causing incorrect display of information about the goods (e.g. color) cannot be the basis for a complaint and return of the purchased goods in EKORR.

§7 Right to withdraw from the contract

1. Pursuant to the Act of March 2, 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product, the Buyer has the right to withdraw from the contract.

2. The Buyer has the right to return the goods without giving a reason, by sending an appropriate written statement to the EKORR headquarters within 14 days from the date of purchase.

3. In the event of withdrawal from the contract, it is considered not concluded and the Buyer is released from all obligations.

4. The Buyer returns the purchased goods to EKORR within 14 days of submitting the statement of withdrawal from the contract.

The returned goods should be intact, complete and in the factory packaging. The goods cannot bear traces of use.

5. The Buyer covers the shipping costs.

6. Refund and issuing of a corrective invoice shall be made after prior inspection of the technical condition of the returned goods.

7. The returned goods should be sent to the address EKORR Rybiccy Sp. J. ul. Instalatorów 23 lok.101, 02-237 Warsaw together with the VAT invoice received with them.

§8 Privacy protection

1. By placing an order in the EKORR store, the Buyer consents to the processing of their personal data solely for the purpose related to the execution of the order. We process the data in a manner consistent with the requirements of the law, in particular in accordance with the Act of 29 August 1997 on the protection of personal data (Journal of Laws No. 133, item 883, as amended).

2. The personal data of Buyers are collected solely and exclusively for the needs of EKORR with its registered office in 02-237 Warsaw, at ul. Instalatorów 23 for marketing and record-keeping purposes.

3. We send advertising and promotional materials to Customers who have given their consent. This applies in particular to the Newsletter sent to the customer if they confirm their willingness to receive it by checking the appropriate box during the registration process.

3. EKORR with its registered office in 02-237 Warsaw, ul. Instalatorów 23 will be the Personal Data Administrator.

4. The Buyer has the right to view their data and update it.

5. In accordance with the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended), we inform that the personal data provided by the Buyer is protected against access by unauthorized persons.

6. The Buyer's data will also be transferred to Przelewy24 (PayPro S.A.), as an electronic payment operator, which will also be the Personal Data Administrator, and to the DPD courier company in order to fulfill the order in terms of delivery.

 

§9 Final provisions

1. The information on the website https://www.ekorr.pl does not constitute an offer within the meaning of Article 543 of the Civil Code.

2. EKORR is not responsible for interruptions in access to the EKORR store resulting from technical reasons.

3. All information regarding the specifications of the products offered comes from materials published by their manufacturers.

4. EKORR reserves the right to change the provisions of the Regulations.

5. These regulations apply.

6. In matters not regulated in these Regulations, the provisions of the Civil Code and the provisions resulting from the Act on the Protection of Certain Consumer Rights shall apply.

§10 GDPR Provisions

1. Personal data, in particular name and surname, address, contact telephone number, e-mail address, hereinafter referred to as "Personal Data", will be processed in accordance with the provisions of the General Data Protection Regulation 2016/679/EC, hereinafter referred to as "GDPR" and in accordance with the Act of 10 May 2018 on the protection of personal data.

2. The Personal Data Administrator is EKORR Rybiccy Sp. J. with its registered office in Warsaw 02-237 at ul. Instalatorów 23, NIP 522-320-87-28, REGON 389812363, KRS 0000918183.

3. EKORR declares that Personal Data processed as part of the performance of the Agreement will be processed solely for the purpose and to the extent necessary to perform the Agreement.

4. EKORR may request the Buyer to provide separate consent to the processing of personal data for marketing purposes.

5. The Buyer declares that it is authorized or will ensure that it will be authorized at the time of making the data available to EKORR to transfer all personal data disclosed during the conclusion and implementation of this Agreement, including in particular the data of employees and other persons implementing this Agreement on behalf of the Buyer, and furthermore undertakes to fulfill the information obligation on behalf of the Buyer, referred to in art. 13 and art. 14 of the GDPR.

§11 Reservations

1. EKORR prohibits the use of materials published on the website https://www.ekorr.pl without the written consent of EKORR.
